Following are the terms and conditions we need you to acknowledge if you want to take part in the YAP competion. As stated before, the deadline for all submissions is the 18th of January.

Terms and Conditions

1. Please note that this Competition is operated by Yahoo! UK Limited ("Yahoo!") and is subject to English law which may not be the same as your local law. Please do not proceed any further if you do not agree to the terms of the site or if access to the site and/or entry into the promotion is contrary to the laws of your country.

2. By entering this competition you agree to these terms and conditions which will at that time become binding between you and Yahoo!. Your participation in the competition is in consideration for Yahoo! allowing you to enter it and giving you the opportunity to win.

3. Yahoo! will send confirmation of your entry into this competition and these terms and conditions to the email address provided upon entry.

4. No purchase is necessary in order to enter the competition. There is no fee charged to enter into this competition other than the cost of you accessing the Internet which you would otherwise have.

5. You must be over 18 and a resident of the United Kingdom to enter into this competition and receive the prize if you win. Employees of Yahoo! or any of its group companies or its agencies associated with this competition are not eligible to enter or participate. Entrants will be deemed be the natural person to whom the email address (provided on entry) is registered. Only one entry per person is permitted.

6. To be eligible, you must submit your application as detailed on the prize draw entry submission page at http://isithackday.com/ukyapcompetition and you shall be subject to the Yahoo! Developer Network Terms of Use http://info.yahoo.com/legal/us/yahoo/api/api-2140.html. Entries must be received not later than 2359 hours (UK time) on 18th January 2010 at which time the offer of this prize draw will end.

7. For each winner, the prize for the competition is for the winning application to appear in the ‘Recommended’ application section on the Yahoo! UK and Ireland homepage for approximately a three week period and in any event, it shall be the sole discretion of Yahoo! to vary this time period. Please note that Yahoo! users may adjust the ‘Recommended’ application section on the Yahoo! UK and Ireland homepage and may consequently remove any application including any winning application from the same. Any pictures used to promote the prize are for information only. The winners are responsible for their own travel, accommodation and subsistence in relation to the prize. The winner must also comply with Yahoo!’s instructions about the prize, such as how to conduct themselves while participating in the prize. There is no cash alternative instead of the prize. There shall be three winning applications in total. The first place winner shall receive a Flip HD (subject to availability) and the winning application shall appear in the top slot of the “Recommended” application section. Should a company submit the winning application and where it has had more than one developer involved in the building of the application, then it will receive a maximum of 3 Flip HDs. The prize for the second place winner is for the second place winning application to appear on the next slot beneath the first winning application on the “Recommended” application section. The prize for the third place winner is for the third place winning application to appear on the next slot beneath the second winning application on the “Recommended” application section.

8. Yahoo! will by a judging panel select three winning applications as a result of 3 minute presentations given by each entrant in front of such judging panel on 20th January 2010 at the Yahoo! YAP event in London (“Event”) and provided that such entrant attends the Event. Yahoo!'s decision is final and no correspondence will be entered into. The winners will be contacted and informed that they have won at the Event and their details may also be posted on the Yahoo! website.

9. (a)Your personal information will be used by Yahoo! to conduct the competition, for participation in the prize and in accordance with Yahoo!'s Privacy Policy, currently located at http://privacy.yahoo.com/privacy/uk, subject to the following, which shall be in addition to the Privacy Policy.

10. (b) If you are a winner of a prize, Yahoo! may use your information collected during the prize draw for marketing or promotional purposes, including using your name and likeness to announce the winners online as described above in section 8.

11. You agree to the processing by Yahoo! and their affiliates of personal information about you submitted when you enter this prize draw or collected if you participate in a prize (including without limitation information about your physical or mental health, racial or ethnic origins, religious or similar beliefs, sexual life, political opinions, trade union membership, criminal convictions or alleged criminal activity, as applicable), for the purposes and in the manner set out above or in that Yahoo! Privacy Policy (including the disclosures of such information or transfer of it to jurisdictions which may not provide the same legal protection as in the United Kingdom or the country in which you are located).

12. Except as otherwise required by applicable law, Yahoo! is not responsible for any loss or damage associated with you entering into this prize draw, the carrying out of the draw or the provision or otherwise of any aspect of any prize or any act or omission of any other person or party, and all warranties, conditions and representations (of any kind) not expressly set out in these terms and conditions are hereby excluded.

13. Yahoo! may terminate these terms and conditions, the competition or any prize if you do not comply with any of these terms and conditions or are unlikely to do so, if Yahoo! decides in its absolute discretion to withdraw the prize draw before any winners are notified, or thereafter if any circumstances beyond Yahoo!’s reasonable control prevent or restrict Yahoo! or any other person or party from providing the prize or any aspect of the prize.

14. You agree that (unless applicable law requires otherwise) any right that you have under applicable law to cancel ends when the prize draw is announced. If thereafter you cannot participate in any prize for reasons beyond your reasonable control, you must notify Yahoo! and Yahoo! may in its absolute discretion give that prize to someone else.

15. You may not assign or transfer your rights or obligations, or subcontract your obligations, under these terms and conditions, such as giving a prize to anyone else, without Yahoo!’s prior written consent. Yahoo! may assign or transfer its rights or obligations, or subcontract its obligations, under these terms and conditions without your consent.

16. Yahoo! or its licensors retain and reserves all rights in and to each website, and all aspects of the competition and each prize, including all derivatives, developments, modifications and improvements.

17. These terms and conditions, and any instructions from Yahoo!, constitute the entire agreement between you and Yahoo!, superseding any prior agreements between you and Yahoo!. Any failure or delay by Yahoo! in exercising or enforcing, or partial exercise or enforcement of, any right or provision of these terms and conditions shall not constitute a waiver of such right or provision (or waive any further exercise or enforcement) or any other right or provision. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision and the other provisions of the terms and conditions will remain in full force and effect.

18. These terms and conditions and all matters arising from or in connection with them are governed by English law and the courts of England will have exclusive jurisdiction in the event of any such dispute.
